Abstract: Based on the need to recapitalize work’s ‘social value’ and worker’s dignity, the study analyses the effect of the complementary compensation to the legally fixed in order to contain the number of unfair ‘aggravated’ dismissals. This approach is partially based on the criminal law conceptual categories of the ‘marginal deterrence’. In turn, on the basis of the assessment of the effectiveness of this approach and the first judicial decisions that held this complementary compensation based on the European Social Charter revised, it is suggested the (urgent) need for a normative regulation that gravitates essentially on the basis of the damages alleged and proven.
