Abstract: The abundance of transactional sexual practices in cyberspace, caused particularly by the spreading of platforms that facilitate cybersex, raises the need to examine what the correct penal response would be towards behaviour that threatens freedom and sexual indemnity in the context of such practices. The transformation that sexual relationships undergo in a digital society throws into sharp relief the profound shortcomings in current regulations of crimes related to prostitution in Spanish law, making it necessary to release criminal policy recommendations that bear in mind other legislative models. Spanish jurisprudence has shown itself to be receptive in the face of the new forms of sexual relationships caused by the digitalization of social life by making flexible the requirements for sexual abuse and aggression crimes, which raises doubts surrounding whether this incurs a violation of the prohibition of the analogical application of criminal law.
