Abstract: This article analyszes the inadequacy of both the concept of consumer and the criterion of active facilitation, used by the Proposal for the draft directive on certain aspects concerning contracts for the supply of digital content, in order to determinate its scope of application. In the digital domain, it is necessary to differentiate between consumers and from non-consumersr users (navigators). The latter need adequate protection from the unlawful acts of digital contents providers. This. And that protection should primarily be providedgranted, mainly, through the institutione of tort law (extracontractual liability).
