Abstract: An in-depth study of legislation in the past two decades shows the emergence of EU lawmakers' support for alternative techniques in conflict resolution in court cases. This support' can be inferred from a series of regulations which appear to be based on a new understanding of article 61 of the European Union Treaty which aims to guarantee adequate levels of legal assistance, thereby making the free movement of individuals and the smooth running of the internal market easier. Legal assistance is considered just and efficient when it aspires to adequate management of conflict resolution. Reconciling the various interests involved and appeasing the parties is a major objective for achieving justice in Europe. The legal system seems to reinforce traditional confrontational practice, the so-called "lose-win" model, which makes it much harder to reach a real rather than just a formal settlement of disagreements. The recent EU directive 2008/52, on mediation, questionable due to its limited range of applications, nevertheless represents a clear manifestation of communitary lawmakers' tendency towards non-confrontational models of resolution.
