Abstract: | Psychopaths commit most frequently serious and violent crimes. Psychopathy is a concept mostly associated with a little realistic mental image, partly due to the contradictory information provided by the scientific community itself. This study¿s first aim is to give a correct and up-to-date view of this phenomenon. But we also face a multifaceted and fascinating reality that shakes the foundations of a legal system that has taken centuries to build and puts the universal validity of our moral principles at stake. Overcoming this barriers is a painful problem in current criminal and penitentiary management, and probably also the cause of the lack of "one voice" decisions in this matter. Creativity, flexibility, courage, objectivity and active collaboration between legal actors and the scientific community are strongly required. This study proposes an evidence-based approach, keeping in mind the need to forget apriorism in order to make room for new and effective outlooks. |
