Abstract: The problem of bullying, known as "Bullying" (Anglicism which means "bully" or search for fights), is a phenomenon that until recently was unknown and hidden, although it has been present over the time in and outside the schools as well as from them and nowadays and more recently through the use of ICTs through internet and mobile telephony. This entails to singularly expand the circumscription of the physical space for it, not only limited to school, but to any place, even in the purest intimacy of the victim. It is important to point out that due to the silence of the victims, witnesses, as well as sometimes of those of the educational centres themselves, it has led to contributing to the ignorance of the magnitude of the problem we are facing. However, at present and due to the important informative work carried out by the social communication media, and the media repercussion that this has had, awareness has been achieved on the part of the current society about the transcendence of this phenomenon among the minor, as well as the serious consequences that can result, both physically and psychologically to the victim of this type of harassment. However, the figure of the harasser-aggressor with respect to the definition of the crime committed and the imputation thereof has not been dealt with with the same information and precision. Therefore, this work will consist of approaching each type of behaviour related to bullying, the criminal type that can typify it and its punitive consequences. We must bear in mind here that there is no unitary criminal legal translation of the behaviours that give rise to this type of harassment, so it is intended to make a journey and approximation on this figure, its characteristics, the subjects that compose it, its regulation, the typification, the degree of imputation of the subjects involved in it, the jurisprudential solutions of this type of crime by our courts and finally the need for an express definition for this harassment nowadays so committed-
