Abstract: | The aim of this study is to analyze the transition to the new system of supports for legal capacity in Catalonia and to conduct a critical review of the respect, by professionals, for the wills and preferences of people subject to a judicial support measure, as well as the assumption of risks and limits associated with the exercise of this. The research aims to articulate different voices: the lived knowledge of a person with a psychiatric diagnostic category subject to a judicial support measure and the technical knowledge of two professionals, a social educator, and a lawyer, dedicated to the implementation of support measures for legal capacity in Catalonia. Navigating through this work has required me to position myself from feminist epistemologies, as indicated by the standpoint theory (Harding, 2016), and to accept the non-neutrality in this research and the biases that permeate both the investigator and the experience being investigated. This study, is not generalizable due to the limitation of the sample of participants, aims to prioritize embodied perspectives and question the hegemony of the mental health care model in Catalonia. |
