Abstract: This study carries on a general reserach in the constructional of national identity for Spanish America during XIXth century ending and the beginning of XXth century by means of understanding psychological knowledge as a scientific tool. During these years, different etnopsychological approaches converted "emotional experience" - aesthetics- in these nations basis of cohesion, authenticity and peculiarity. In this sense, and mainly within the intellectual circles of Latin tradition countries, artistic products (poetry, painting....) were considered the privileged expression of the "national character" and the society's cultural values, But that psycho-sociological thoughts implies, on the contrary, an antagonistic side related to social degeneracy:that is, to marginlaity, delinquency, madness, or even anarchist terrorism. For XIX century-ending reformists, these were antisocial and countercultural elements that should be controlled or extirpated from tha national project in the light of evolutionism and criminal anthropology. Obviously, these elements also had their aesthetic displays-degenerated or atavistic-, far from being socially acceptable. This is the csse of jargons, tattoos, or some dances. Our analysis focus on the countercultural dimension of aesthetics and art, and how this dimension is built within the psycho-sociological contesxt of Spanish America nations at the very ends of XIX century. Two eminent scholar who studied aesthetics from the point of view of criminology will be analysed: Spanish Rafael Salillas, (El Delincuente español: Hampa), and Argentinean José ingenieros ( Psicopatología del arte" o " Criminología).
