Abstract: The research you have in your hands belongs to the TFG subject of the UOC Law Degree. We carried out an analysis about the institution of the Plea Bargaining performance in Spain, from a legal perspective and emphasizing on its regulation and its relationship with Spanish constitutional values. In this sense, we contextualized its origin regarding to the concept of "negotiated justice" in criminal cases in USA, and we studied the relationship that this institution expresses with legal principles such as discretion or legality, since they are the ones that configure and act both inside and outside our borders. Finally, we elaborated a brief comparison regarding to the Plea Bargaining legal framework in order to conclude those areas in which they are related and those ones in which they are not.
