Abstract: The circulation of motor vehicles is a daily occurrence which unfortunately causes accidents resulting in personal injury and material damage, sometimes irreversible. For all these reasons, it is undeniable that there is an inherent risk for society in the circulation of motor vehicles. Our legal system considers the circulation of motor vehicles as a legal fact from which legal consequences are derived, regulated by law, in order to compensate and avoid, as far as possible, the damage arising from it. The system of valuation of damages caused to people in traffic accidents, known as "baremo", is particularly relevant as it is used as a criterion to determine the financial compensation for damages that occur in areas other than the circulation of motor vehicles. By means of this paper, we will attempt to study in depth both the substantive and procedural law relating to this matter with the aim of gaining greater knowledge of its consequences and institutions, as well as the jurisdictional channels that must be followed in order to achieve effective compensation.
