¿Se encuentra la obligación internacional de rescate en declive ante las políticas estatales de “puertos cerrados”?

Abstract

Carola Rackete fue arrestada el pasado verano tras atracar su embarcación, Sea-Watch3, en la isla de Lampedusa con más de cuarenta refugiados a bordo. Si bien, finalmente, la justicia italiana desestimó a los pocos días la mayoría de los cargos que la Fiscalía le había imputado, resulta de interés traer a colación los referidos hechos, así como otros muy similares en la medida en que están suscitando un profundo debate en torno al alcance que tiene la obligación internacional de rescate a la luz de estrategias domésticas adoptadas con el objetivo de impedir el desembarco de personas rescatadas. Analizaremos, pues, la regulación internacional aplicable para determinar su eficacia y concluir de qué manera deben proceder los Estados a la hora de procurar un cumplimiento íntegro de la citada obligación.

Carola Rackete was arrested on June of 2019 after docking her ship, Sea-Watch 3, on the island of Lampedusa with more than forty refugees on board. Although the Italian justice dismissed most of the charges raised by the Prosecutor’s Office against her, it is of interest to bring up the aforementioned facts, as well as other similar ones as they are raising a deep debate regarding the scope and the effect of the international rescue obligation. Within this context, it must be highlighted that the implementation of domestic strategies adopted with the objective of preventing the disembarkation of rescued persons has aggravated the matter. Consequently, we will analyze if the mentioned obligation is able to confront the perverse effects caused by the internal policies cited before.
