Title: Los cuidados como derecho fundamental

Abstract: In recent times, care has become a central issue in the public policies of many countries around the world, especially in the West. The vast majority of these countries have developed care strategies, mainly for long-term care, due to the demographic evolution of the population. Spain is not lagging behind and is currently developing its national care strategy, for which it has a roadmap. However, the need to address the whole issue from a legal perspective, i.e., the consideration of the creation of a new right to care, has not yet been raised. This paper attempts to advance a possible framework for the creation of the right to care (to care and to be cared for), bearing in mind that it would be a new social, subjective and universal right, and therefore of a fundamental nature, with constitutional guarantees for its implementation. Determining the concept is complex due to the enormous scope and meaning that it has for every person throughout their lives; however, in an attempt to give greater determination to the right and given the existing legislation related to the possible right, an approximation to its conceptualisation is made.
