Estado actual y perspectivas de futuro de la potestad autonómica para crear impuestos propios

Abstract

Despite their relevance as a source of funding and their chaotic proliferation in recent times, the revenue from the power of Autonomous Communities to create their own taxes is almost testimonial. The regulation of these taxes, scattered and confused, has become a source of multiple legal and political conflicts, which resulted in not always clear and consistent jurisprudence of the Constitutional Court. For that reason, and keeping in mind the limitations that are arriving from the European Union, it is necessary to develop an updated study of that power, and it is the main objective of this work. In particular, an overview of its current status in the different Autonomous Communities will be provided (with special reference to Catalonia). Moreover, the determination of the main problems encountered and a first approach about its future will be done.

A pesar de su relevancia en cuanto a fuente de financiación y de su proliferación desordenada en los últimos tiempos, la recaudación proveniente de la potestad autonómica para crear impuestos propios es prácticamente testimonial. Su regulación, dispersa y confusa, se ha convertido en una fuente de múltiples conflictos jurídicos y políticos, lo que ha conlle- vado que se haya ido esgrimiendo mediante la jurisprudencia no siempre clara y coherente del TC. Por consiguiente, y sin olvidar las limitaciones que van cobrando fuerza provenientes de la UE, resulta necesario elaborar un estudio actualizado de la mencionada potestad con el fin de ofrecer una visión completa y actualizada de la misma, lo cual constituye el principal objetivo del presente trabajo. Así, en él se aporta una visión panorámica de su estado actual en las diferentes autonomías de régimen común, con especial referencia a Cataluña, junto con la determinación de los principales problemas que se observan y una primera aproximación en relación con su futuro.
