El contrato de arrendamiento: análisis comparativo y traductológico y traducción inglés-español de sus cláusulas

Abstract

En los últimos años los fenómenos de la globalización y la internacionalización han plasmado un mundo profundamente interconectado. Por consiguiente, la libre circulación de personas en cada rincón del planeta ha causado un incremento de la demanda de vivienda, por lo que la traducción de contratos de arrendamiento ha experimentado un aumento exponencial. Si se considera que un contrato, sea del tipo que sea, es un documento legal que establece las condiciones de un acuerdo entre dos o más partes, y para que las partes involucradas puedan firmar dicho contrato tienen que poder entender plenamente cada cláusula presente en el documento. Tras un análisis teórico en el que se investigan la macroestructura, las características lingüísticas de los contratos de arrendamiento, así como las leyes que los regulan, se ofrece una posible traducción al español de un contrato de arrendamiento inglés, que se complementa con un glosario bilingüe inglés-español que incluye la terminología utilizada en el contrato analizado. El trabajo finalizará con el análisis tanto de las características del texto traducido, como de los procedimientos de traducción adoptados. Finalmente, se mencionan las habilidades que un profesional de la traducción jurídica debe poseer para garantizar un texto de alta calidad lingüística y que fluya con naturalidad en la lengua de llegada.

The phenomena of globalization and internationalization have shaped a deeply interconnected world in the last few years. Consequently, the free movement of people in every corner of the planet has caused an increase in the demand for residential property, which has led to an exponential increase in the translation of lease agreements. Considering that an agreement, whatever type it may be, is a legal document that sets out the terms of an agreement between two or more parties, and for the parties involved to be able to sign a contract, they must be able to fully understand each covenant included in the document. After a theoretical analysis, macrostructure, textual and linguistic characteristics of lease agreement are investigated, as well as the laws that regulate them, we provide a possible Spanish translation of an English lease agreement, which is complemented with a bilingual English-Spanish glossary that includes the terminology used in the analyzed contract. The study will end with an analysis of both the characteristics of the translated text and the translation procedures adopted. Finally, the skills that a professional legal translator must possess in order to guarantee a high linguistic quality text that flows naturally in the target language are mentioned.
