Abstract: Art. 92.8 of the Spanish civil Code, as amended by the 2005 reform, establishes the exceptional possibility that the judge, at the request of only one of the parties, agrees to grant shared custody. The requirement for the adoption of this measure is that this is the only way of protecting the best interests of the child. Recently, a Supreme Court Decision has interpreted that Courts, when deciding custody cases, must follow the best interests of the child principle, and justify the decision on those grounds, rather than follow the exact wording of art. 92.8.
