Abstract: This work is based on the legal environment related to software development and the different options that a developer has when they try to legally protect their application. The result of this work is a memory and a brief guide, both mainly focused to developers. The memory makes a theoretical approach from the legal point of view, both European and Spanish law, to three main concepts linked to the legality of software: copyright, inventive patents and free software. Finally the guide, in a separate document, collects briefly and in a visual way all those steps and key concepts that have to be considered in a practical approach when a software needs to be legally protected.
