Abstract: Being a member of the EU does not always mean that the different Member States take similar action. The transformation of the common European policy, the emergence of new migratory movements and the diversity in the application of the right of asylum determine, among other things, the actions of the European States. Countries such as Spain and Hungary serve as examples to show how changes in European migration and border policies, the influence of national regulations and the different interpretation of common rules can affect the right of asylum. It is therefore fundamental for the development of future EU policies to know, on the one hand, the changes in the common regulation of borders and asylum and, on the other, to analyse whether the variation in European regulations affects the right to asylum.
