| Abstract: | Based on the jurisprudence rules that has held that an age criterion has provoked a negative discrimination, this study, firstly, analyzes a case resolved by the TSJ of Andalusia in which has used as a positive discrimination criterion based on the Kaldor-Hicks efficiency concept; and, secondly, it projects the effects that this doctrine could have in the resolution of this type of controversies. |
