Title: Voluntariat i relacions laborals: el personal tècnic esportiu

Abstract: Non-profit sports clubs have become an important player in today's society. Their activity, focused on the promotion and encouragement of sport, goes beyond the practice of sport and provides numerous physical, psychological and social benefits. The participation of volunteers in the clubs' activities has been a key element in making their social objectives possible. The existence of this non-professional figure has allowed the clubs to offer a wide variety of services at an affordable cost its members, and consequently, guaranteeing and facilitating access to sports to everyone. However, the organizational structures of the clubs are increasingly becoming more complex and professional in order to be more competitive and differentiate themselves from the concurrence, a fact that has also resulted in a broader and stricter regulation of sporting activity, with the appearance of academic qualifications, professional associations, official registers, etc. The evolution towards professionalization has aroused conflicts more typical from the work environment and resulting intervention of the Public Administration to guarantee the compliance of the legal regulations in force. Nowadays, the situation of the technical staff in sports clubs is controversial. Although there is a legal framework that regulates volunteering and labour relations, the practice of "brown amateurism" is a common phenomenon in many entities. Likewise, in those cases in which there is a strong commitment to hiring the personnel, it’s not clearly specified what the most appropriate applicable regulatory framework is. Based on a normative and jurisprudential analysis, this work will define the different options that clubs have regarding their relationship with the technical staff. Subsequently, with the field work carried out, we will define the current situation and the alternatives that have been proposed in order to offer viable future prospects for all parties involved in this problem.
