Abstract: | In the year 2023 it is still necessary to affirm the obvious: violence against women exists. Sexual violence, in particular, is a social problem that has required changes within the penal system and continues to be the subject of debate. The main objective of this bibliographical review is to identify the evolution of sexual consent in the Spanish state from a critical and feminist analysis, as well as to analyze the progress of legislation related to the crimes of sexual abuse and assault. The introduction of Organic Law 10/2022, of September 6, on the comprehensive guarantee of sexual freedom, fundamentally modifies consent in matters of sexual relations; it is presented positively as a criterion for determining whether an act is a sexual assault or a consensual sexual encounter. Thus, in the present TFG it is intended, first of all, to delve into the historical journey of sexual consent in Spain and to analyze both the contributions of the “Only Yes is Yes” Law and the current feminist debates around it. On the other hand, to identify the value of feminist sex education to Sex Education to facilitate a paradigm shift from the entrenched “rape culture” to a “consent culture”. In summary, to promote women's rights and ensure their safety, it is imperative that we understand the complexities of sexual consent as a central concept. This includes acknowledging the historical context, debates, and diverse perspectives surrounding the issue. Defending sexual freedom, gender equality and a life free from violence requires a feminist society that serves as a catalyst for social change. |
