Abstract: Reflecting national constitutions, the European Union (EU) has endowed itself with fundamental values - democracy, the rule of law and respect for human rights - now enshrined in Article 2 of the EU Treaty. These axiological values legitimise the EU's existence, underpin its action and reflect its identity. There is therefore a certain presumption of respect for these values on the part of both the European institutions and its Member States. On the basis of this internal legitimacy, the EU externalises its values, promoting respect for them in different dimensions of its external action. However, the illiberal drifts of some EU member states call this assumption into question and force a rethink of how to ensure respect for EU values internally. This is necessary not only to ensure the credibility of the EU's external action, but also for the very existence of the EU legal order, as demonstrated by the recent decision of a Dutch court refusing the execution of a European arrest warrant in Poland. This article analyses the role of the European judiciary in safeguarding the rule of law, and the corresponding role of national courts in the area of freedom, security and justice.
