Abstract: The increase in the use of technology has led a large part of the world's population to become accustomed to consulting, collecting and handling large amounts of data, which are used for very different purposes. This study analyses what happens to all those data and digital content after the death of the person. To this end, the regulation of personal data in the European context is examined and that leads us to address the jurisprudential and legislative antecedents that lead us to the current Spanish Organic Act 3/2018 of 5 December on the protection of personal data and guarantee of digital rights, which has dealt with the issue of the data of deceased persons.
