| Abstract: | The Act 15/2005, of 8th of July, explicitly regulates joint custody agreements in case of marriage break-up. As a novelty, the Act 15/2005 allows the court to decide upon it, even if it is only asked by one spouse. This paper examines the legal and economic grounds of joint custody, since far from being a marginal solution, it is effectively applied by our courts, as SAP Barcelona, Civil, Sec. 18ª, 20.2.2007 shows. |
