Title: Contratación menor en el sector público: Opacidad versus e-administración transparente

Abstract: The opacity of the public sector, in terms of public procurement, has been a widespread characteristic until recent times. However, the EU directives have introduced fundamental changes in the regulations of the States, regulating the transparency and applicability of electronic means in this field of action, which has allowed for the modification of long-standing, possibly abusive, unjustifiable administrative actions in a State governed by the rule of law. . The minor contract, exceptional figure, unique in the European context, has been generalized in our country to the thread of possible fraudulent or corrupt activities that extend to almost the infinite time limit and split contracts to avoid competition. It corresponds to the Public Administrations to arbitrate the suitable formulas to guarantee the general principles of the administrative contracting, consecrated in the communitarian norm and reflected in the national legislation.
