Abstract: The essay focuses on the new definition of 'rebus sic stantibus' civil law clause proposed by the Spanish Supreme Court and analyzes its effects on the labour law framework and, specifically, the dogmatic grounds of the unilateral changes in terms and condition of employment. The paper concludes rejecting this new jurisprudential definition and defends the validity of the 'excesiva onerosidad sobrevenida' theory. Finally, the essay (in a brief addendum) analyzes the impact of this dogmatic discussion on the decision of the Spanish Supreme Court of December 22nd, 2014.
