Abstract: In this research I want to assess whether Spanish democracy is of a low quality, according to Diamond & Morlino's (2005) theory. For this purpose is taken the speech of the Spanish Senate political elites during the processing of article 155 Constitution, as well as the procedure followed in its processing, as indicators of a political culture that legitimizes tolerance towards abuses, deviations and corruptions; it is analyzed what arguments are taken into account during the debate, and it is based on three hypotheses: H1 Spanish democracy is, in comparative terms, a low quality democracy in the Rule of law dimension; H2 During the debates, the deliberative theory of democracy is not fulfilled; and H3 At the Senate, the majority decisions prevail over those that are just.
