Abstract: Carola Rackete was arrested on June of 2019 after docking her ship, Sea-Watch 3, on the island of Lampedusa with more than forty refugees on board. Although the Italian justice dismissed most of the charges raised by the Prosecutor’s Office against her, it is of interest to bring up the aforementioned facts, as well as other similar ones as they are raising a deep debate regarding the scope and the effect of the international rescue obligation. Within this context, it must be highlighted that the implementation of domestic strategies adopted with the objective of preventing the disembarkation of rescued persons has aggravated the matter. Consequently, we will analyze if the mentioned obligation is able to confront the perverse effects caused by the internal policies cited before.
