| Abstract: | The potential secondary liability of online auction platforms for counterfeit goods is still a problem marked by a large degree of legal uncertainty. This note analyzes one of the key issues in this debate: the discussion on the applicability of the rules that limit the liability of providers of information society services, paying special attention to the rulings issued in France and Belgium in cases brought by trademark rights holders against eBay. |
