Abstract: The aim of this paper is to briefly present the pragmatic conception of law by the Spanish criminologist Quintiliano Saldaña (1878-1938). This author considers his «legal pragmatism» as a possible solution to the practical difficulty in attributing responsibility; that is, as a possible solution to the problem of attributing moral and legal responsibility to a «determined subject», according to science. Specifically, Saldaña, inspired by William James and Jeremy Bentham, claim the need to put an end to controversies on the subject of law and the legal entity: legal reality should be understood as a set of concepts that are true because they help to protect situations that should be protected.
