Abstract: In a serious an imminent risk scenario, the legitimacy of a decision paralyzing the business activity depends on the rationality of the probability judgment of the decision-making person. In order to evaluate legally the behaviour of someone in a situation such as it is described by the articles 21.2 and 3 and 44 LPRL and given the Law limitations to provide a "probability" definition, this study proposes some judgment rules based on main concepts of psychology of conduct (such as representativeness heuristic, the conjunction fallacy, and the availability bias) and some elementary statistical concepts. These rules, and especially in the context of the pandemic, aspire to contextualize the reasoning that has precipitated these decisions and, therefore, facilitate its legal qualification.
